Trademark Infringement

Trademark infringement occurs when a party uses a trademark that is identical or confusingly similar to another party’s registered trademark in connection with goods or services without authorization. This can lead to consumer confusion and dilution of the original mark’s distinctiveness. Our firm specializes in assisting trademark holders in enforcing their rights against infringers through legal actions such as cease and desist letters, litigation, and seeking damages for infringement.

Trademark Maintenance

Trademark maintenance is crucial for preserving the value and enforceability of trademarks. Our law firm offers comprehensive maintenance services to ensure that trademarks remain valid and protected. This includes monitoring for unauthorized use, renewing registrations, and providing guidance on maintaining the distinctiveness of the mark through proper usage and branding strategies. By proactively managing trademark maintenance, businesses can safeguard their valuable intellectual property assets.

Trademark Renewals

Trademark registrations require periodic renewal to maintain their validity and enforceability. Our trademark attorneys offer efficient and reliable trademark renewal services to help businesses stay compliant with renewal deadlines and protect their valuable brand assets. We handle the entire renewal process, including monitoring renewal deadlines, preparing and filing renewal applications, and managing any necessary communications with the USPTO. With our experience, clients can rest assured that their trademarks remain protected for years to come.

Trademark Opposition / Cancellation

Trademark opposition and cancellation proceedings are legal actions initiated to challenge the validity or registration of a trademark. Our trademark team specializes in representing clients in opposition and cancellation proceedings before the USPTO’s Trademark Trial and Appeal Board (TTAB). Whether our clients seek to oppose the registration of a conflicting trademark or defend their own trademark against cancellation, we provide strategic guidance and advocacy to protect their interests. Our attorneys have extensive experience navigating the complexities of trademark litigation and achieving favorable outcomes for our clients.

Trade Names

A trade name is the official name under which a company conducts its business activities and is often used interchangeably with a business name or DBA (doing business as) name. Choosing and protecting a trade name is essential for establishing brand identity and avoiding confusion with competitors. Our firm assists businesses in selecting distinctive and legally protectable trade names, conducting comprehensive searches to ensure availability, and registering trade names for legal protection. We also provide guidance on maintaining the distinctiveness and integrity of trade names through proper usage and branding strategies.

Where is a Trademark protected?

Trademarks protect a brand in all 50 states when filed in the United States.  A trademark attorney can help navigate the complexities of a trademark application.

Why should I get a Trademark?

Growth: If you plan to grow your brand beyond the state in which you start your business, a Trademark can help protect your ability to use the brand in geographies across the United States.

Competitive Industry: If your business is in a competitive industry in which there are many similar brands, it is not uncommon where one brand is so similar to another such that there may be allegations of infringement.

Risk of Infringement Disputes: Even if you don’t register a trademark, you still may have common law trademark rights.  This doesn’t mean someone else in another state is aware of your business and won’t register a trademark for the same name.

When should I get a Trademark?

A trademark may be filed either before it is used in commerce or after. A trademark can be filed at any time, but it is generally advisable to file sooner rather than later.

How do I get a Trademark?

Trademark law firms typically start the trademark process with a trademark search.  A trademark search generally comprises looking at filed trademarks with the USPTO and basic internet searching of the potential mark.  After that, the trademark lawyer would assemble the documentation and then submit it to the USPTO.

How long does it take to get a Trademark?

To obtain a trademark certificate can take 12 to 18 months.

Is filing a trade name with the secretary of state the same as having a trademark?

No, having a trade name filed with the secretary of state does not protect a business outside of the geographical locations that a business is registered and conducting business. Registering for a trademark with the USPTO protects the business country-wide.
